800 MHz Transition Administrator Provides Guidance on ESMR Elections

Filing Instructions and Supporting Information Provided

January 6, 2005, Washington, D.C. – The 800 MHz Transition Administrator ("TA") today provded guidance to Enhanced Specialized Mobile Radio Systems ("ESMRs") required to file 800 MHz relocation elections with the TA. Pursuant to an Order of the Federal Communications Commission ("FCC") requiring the reconfiguration of the 800 MHz band to resolve harmful interference to public safety and other licensees ("800 MHz Order"), ESMRs employing cellular-type systems in the 800 MHz band must elect one of the following options: (1) relocate all of their systems in a market into the new ESMR portion of the 800 MHz band; (2) to relocate their systems as close as possible to the new ESMR band but remain in the non-cellular portion of the band operating on a strict non-interference basis; or (3) to remain on their current channels on a strict non-interference basis. ESMR operators should identify their election(s) by Economic Area ("EA").


Entities unsure of their eligibility to file ESMR elections should consult the definitions of SMR and ESMR in Section 907 of the FCC's rules and Appendix C of the FCC's 800 MHz Order. Non-ESMR EA licensees and other non-ESMR licensees eligible to make various relocation elections as part of the 800 MHz reconfiguration process will be provided guidance related to their elections in the near future.


Filing Timeframes and Instructions. Because the TA must provide its regional prioritization plan to the FCC by January 31, 2005, ESMR operators must file their relocation elections as soon as possible, but no later than January 21, 2005. ESMR elections should be made in paper form with an original signature, sent via courier, overnight mail, or some other trackable form of delivery to:

An electronic PDF copy should be also emailed to the TA at ESMR.election@800TA.org. The TA will provide electronic confirmation of ESMR elections. ESMR filers are also reminded to file a copy of their elections with the FCC in WT Docket 02-55.


Supporting Information. The TA request that ESMR operators provide the following information in support of their elections:
  • Contact Information;
  • Call signs of all relevant licenses (including licenses for site-based cells) cross-referenced by EA;
  • Documentary evidence of an operating high-density system with (1) more than five overlapping interactive sites featuring hand-off capability and (2) at least one site with an antenna height of less than 30.4 meters (100 ft.) above ground level with an antenna height of above average terrain (HAAT) of less than 152.4 meters (500 ft.) and 20 or more paired frequencies;
  • For ESMR operators electing to relocate site-base cells, documentary evidence that each site-based cell was an integral part of the EA licensee's ESMR system as of November 22, 2004. A cell that is an integral part of an ESMR system is a cell that has a 40 dBu/V coverage contour overlapping the 40 dBu/V coverage contour of another cell integral to the ESMR system, and must be capable of "hand-off" of calls to and from the cell its 40 dBu/V coverage contour overlaps; and
  • A signed and dated certification under penalty of perjury that the filer meets the definition of "ESMR" found in the 800 MHz Order as of November 22, 2004 and that the information provided in the election is true and correct. Filers should consult 47 C.F.R. 1.16 for the appropriate form of certification.

About the 800 MHz Transition Administrator, LLC

800 MHz Transition Administrator, LLC ("TA LLC") is the Transition Administrator ("TA") for the reconfiguration of the 800 MHz band mandated by the Federal Communications Commission ("FCC"). TA LLC has contracted with BearingPoint, Inc., Squire, Sanders & Dempsey L.L.P. and Baseline Telecom, Inc. to perform the duties of the TA. Among its duties, the TA establishes reconfiguration guidelines, specifies replacement channels, reviews reconfiguration cost estimates, monitors payment of reconfiguration costs, manages the relocation schedule, facilitates issue resolution and administers the alternative dispute resolution process. TA LLC uses information it receives solely for the purposes of administering the 800 MHz reconfiguration process and may disclose such information to the FCC or other authorized parties pursuant to the requirements of the 800 MHz Order or other applicable laws.
