The FCC Announces Extension to Wave 1, Stage 2 Mandatory Negotiations and the TA Provides RFPF Submission Deadline

May 30, 2006, Washington, D.C. - On May 26, 2006, the FCC issued a Public Notice approving a three-month extension to the Wave 1, Stage 2 Mandatory Negotiations period.

Based on this extension, Wave 1, Stage 2 licensees and Sprint Nextel will have until October 31, 2006 to negotiate a Frequency Reconfiguration Agreement (FRA) before entering Alternative Dispute Resolution (ADR).

The revised Wave 1, Stage 2 timeframe is as follows:

Mandatory Negotiations: May 1, 2006 - October 31, 2006
Alternative Dispute Resolution: November 1, 2006 - December 14, 2006

"The TA believes that adjusting the length of time for Wave 1, Stage 2 Mandatory Negotiations will allow licensees and Sprint Nextel the additional necessary time for these complex systems to negotiate a Frequency Reconfiguration Agreement,” said Brett Haan, Director, 800 MHz Transition Administrator, LLC. “All parties should continue their most diligent efforts to reach agreements and move through the process consistent with the national priority established by the Commission to protect critical public safety communications by completing 800 MHz band reconfiguration."

The extension of negotiations for Wave 1, Stage 2 will not alter the basic structure and sequencing of the four waves as established in the Regional Prioritization Plan, and will have no impact on the established 18-month, 30-month and 36-month schedule deadlines and milestones for 800 MHz Reconfiguration.

Wave 1, Stage 2 Request for Planning Funding (RFPF) Deadlines

Based on the extension to Wave 1, Stage 2 Mandatory Negotiations, the TA announces the following RFPF submission deadline to encourage timely Planning Funding Agreement (PFA) negotiations in accordance with the revised schedule.

Wave 1, Stage 2 July 17, 2006

RFPF deadlines are provided to encourage licensees to consider their planning funding needs in a manner consistent with the revised schedule. Adherence to the RFPF deadlines and to the TA’s RFPF process will afford licensees and Sprint Nextel appropriate time within the negotiation windows to negotiate an FRA.

Please note that all RFPF submissions must be completed in the most current template format provided by the TA (http://www.800ta.org/content/documents/rfpf_forms.asp). Licensees wishing to participate in the new PFA Fast Track process must use version 2.6 (or higher), which will be available in early June.

About the 800 MHz Transition Administrator, LLC
800 MHz Transition Administrator, LLC ("TA LLC") is the Transition Administrator ("TA") for the reconfiguration of the 800 MHz band mandated by the Federal Communications Commission ("FCC"). TA LLC has contracted with BearingPoint, Inc., Squire, Sanders & Dempsey L.L.P. and Baseline Telecom, Inc. to perform the duties of the TA. Among its duties, the TA establishes reconfiguration guidelines, specifies replacement channels, reviews reconfiguration cost estimates, monitors payment of reconfiguration costs, manages the relocation schedule, facilitates issue resolution and administers the alternative dispute resolution process. TA LLC uses information it receives solely for the purposes of administering the 800 MHz reconfiguration process and may disclose such information to the FCC or other authorized parties pursuant to the requirements of the 800 MHz Order or other applicable laws.
