Wave 4, Stage 1 Negotiation Period Extended for Border-Area Non-NPSPAC Licensees

April 30, 2007, Washington, D.C. — On March 30, 2007, the Federal Communications Commission (FCC) issued a Public Notice extending the mandatory negotiation period for Wave 4, Stage 1 border area non-NPSPAC licensees by an additional 90 days from April 2, 2007 to July 1, 2007 and postponing the start of the mediation period until July 2, 2007 for such licensees. The FCC also extended the filing freeze on new applications in Wave 4, Stage 1 border areas until August 13, 2007. The change to the schedule also affects licensees for which the 800 MHz Transition Administrator, LLC (TA) has not provided proposed replacement frequencies due to proximity to the border area. Rebanding of licensees located in, or affected by, the border area is affected by ongoing discussions with the Governments of Mexico and Canada regarding border area frequency plans.

The extension of the negotiation period will alleviate administrative burdens on licensees, avoid unnecessary rebanding expenditures, and provide additional time for resolution of border issues and issuance of frequency designations by the TA.

During the extended negotiation period, Wave 4, Stage 1 licensees located in, or affected by, the border area are not required to engage in planning or negotiation prior to the receipt of proposed replacement frequencies from the TA, though they may engage in such activities to the extent that they are not frequency-dependent and would not result in unnecessary duplication of costs. Licensees can elect to engage in such planning and negotiation activities if they meet the above criteria. If planning funding is required, licensees will need to submit a Request for Planning Funding (RFPF) to the TA and negotiate a Planning Funding Agreement (PFA) with Sprint Nextel.

Wave 4, Stage 1 licensees outside the border areas are not affected by this extension. Those licensees should follow the previously announced negotiation and mediation schedule for this wave.

For questions regarding Special Temporary Authorizations, please contact the TA by phone at (888) 800-8220, by fax at (888) 701-4380, or via email at comments@800TA.org.
