Wave 3, Stage 2 - Start of Alternative Dispute Resolution

May 1, 2007, Washington, D.C. — As scheduled in the Regional Prioritization Plan (RPP), the mandatory negotiation period for Wave 3, Stage 2 licensees ended on April 30, 2007. Licensees that did not reach a Frequency Reconfiguration Agreement (FRA) with Sprint Nextel entered mediation on May 1, 2007, as part of the Alternative Dispute Resolution (ADR), or mediation, process established by the 800 MHz Transition Administrator, LLC (TA). Mediation is intended to assist the parties in reaching an FRA.

The cornerstone of the TA's ADR Plan and practice is flexibility. As a result, all activities within mediation will be scaled according to the needs of the parties in reaching agreement and resolving disputes.

To address the unique aspects of Public Safety reconfiguration, the TA has provided training to all TA mediators regarding Public Safety communications issues and concerns. The TA mediation team understands and appreciates the complexities of Public Safety systems and has worked to prepare the mediators for the unique challenges and complexities presented by Public Safety systems. The TA mediators also have access to the TA's extensive engineering, operational, and management expertise in Public Safety communications. At any time during the mediation process, the TA mediators may request technical support and other guidance from the TA regarding issues presented by the parties.

The TA is committed to supporting the parties throughout the mediation process and encourages any licensee with questions or concerns to bring these to the attention of the licensee's assigned TA mediator at the outset of the process. About the 800 MHz Transition Administrator

800 MHz Transition Administrator, LLC ("TA LLC") is the Transition Administrator ("TA") for the reconfiguration of the 800 MHz band mandated by the Federal Communications Commission ("FCC"). TA LLC has contracted with BearingPoint, Inc., Squire, Sanders & Dempsey L.L.P. and Baseline Telecom, Inc. to perform the duties of the TA. Among its duties, the TA establishes reconfiguration guidelines, specifies replacement channels, reviews reconfiguration cost estimates, monitors payment of reconfiguration costs, manages the relocation schedule, facilitates issue resolution and administers the alternative dispute resolution process. TA LLC uses information it receives solely for the purposes of administering the 800 MHz reconfiguration process and may disclose such information to the FCC or other authorized parties pursuant to the requirements of the 800 MHz Order or other applicable laws.
